Terms of Service

The ground rules for using the Berryin website and platform.

This document is a plain-language starting point and has not been reviewed by a lawyer. Please have it checked against your jurisdiction before you publish.

1. These terms

These terms apply when you use berryin.com or subscribe to the Berryin platform. By using the service you agree to them.

2. Your account

You are responsible for the accounts you create for your restaurant and for the actions taken by your staff under those accounts. Keep credentials confidential and tell us promptly if you think an account has been compromised.

3. Subscriptions and billing

Berryin is sold as a subscription. Plans are billed monthly or annually in advance, in the currency shown on the pricing page, and exclude any applicable taxes.

  • Berryin charges no commission on orders processed through the platform.
  • Payment processing fees charged by third-party payment providers are separate and are set by those providers.
  • Plan limits (branches, staff accounts and features) are as described on the pricing page at the time you subscribe.

4. Changes to plans and prices

We may change plan pricing or contents. Where a change affects an active subscription we will give reasonable advance notice, and the new price will apply from your next renewal.

5. Acceptable use

You agree not to:

  • Use Berryin for anything unlawful or to sell goods you are not permitted to sell.
  • Attempt to break, overload, reverse-engineer or gain unauthorised access to the platform.
  • Resell or sublicense access to Berryin without our written agreement.
  • Upload content you do not have the right to use, including menu photography and trademarks.

6. Your data and content

You keep ownership of your menu, customer records, order history and any content you upload. You grant us the limited licence needed to host and process that content so we can provide the service. We handle personal information as described in our Privacy Policy.

7. Availability and support

We work to keep Berryin available and reliable, and every plan includes onboarding and ongoing support. Planned maintenance is scheduled outside peak service hours where possible. Formal uptime commitments apply only where an SLA has been agreed in writing, as offered on the Enterprise plan.

8. Third-party services

Berryin connects to third-party services such as payment gateways, mapping and messaging providers. Those services are governed by their own terms, and we are not responsible for their availability or actions.

9. Suspension and termination

You may cancel your subscription at any time, effective at the end of the current billing period. We may suspend or terminate access if fees remain unpaid or if these terms are seriously breached. On termination you may export your data for a reasonable period before it is deleted.

10. Liability

To the extent permitted by law, Berryin is provided "as is" and our total liability for any claim is limited to the subscription fees you paid in the twelve months before the claim arose. We are not liable for indirect or consequential losses such as lost profits.

11. Changes to these terms

We may update these terms from time to time. If a change is material we will update the date at the top of this page and notify active customers.
